​The Child Custody Act​

aka "Damon's Act"

The Child Custody Act will effectively end the Custody Crisis by implementing a new system that provides due process for parents and protection for children.

Main reforms: custody cases are heard in a regular civil court with a jury; children are interviewed forensically; no court-appointed professionals; best interest of the children to live with primary parent.

Characteristics of Child Custody Courts
  • Custody cases heard in regular civil court
  • Right to a speedy jury trial
  • Videotaped forensic interview of child ​​​​
  • Child may testify by closed circuit TV​
  • Parents may hire experts to testify regarding abuse​
  • Law enforcement and forensic interviewer evidence admissible​​
  • Primary attachment figure gets temporary primary custody
  • No mandatory or recommending mediation
  • Judge may not issue gag orders or seal records unless both parents agree​
  • No evaluators, children’s attorneys, psychologists, therapists, et. al.
  • Psychological evaluations may not be ordered
  • No social services involvement unless jury finds both parents abusive​
At conclusion of trial:
  • Jury decides two things by preponderance of the evidence
    • 1) who is the primary parent/attachment figure
    • 2) whether either parent has been physically or sexually abusive
  • Primary parent gets primary custody; other parent gets regular visitation
  • Visits with physically abusive parent must be professionally supervised 
  • No contact with a sexually abusive parent
  • Judge may not overrule the jury verdict​
  • Database created to document outcomes​

Women must unite as a class to demand the "Child Custody Act"
be enacted, as there'll be tremendous resistance to a reform
​which reduces men's power in the family.

"Damon's Act" is named after a brave boy
who was forced into the sole custody of his sexually abusive father
despite his mother's tireless efforts to protect him in Family Court.

NOTE OF CAUTION

NOTE:  The reforms detailed in the Child Custody Act must not be used in part. Every reform in the Child Custody Act is necessary to end the crisis. Anything less will allow for loopholes which will enable judges to continue to spin cases to the father.
